Terms & Conditions - FLAIR INNER SANCTUM COMPETITION – 31st July 2010

Full Terms and Conditions

1. Information on how to enter and the prize forms part of these conditions of entry. Entry into this competition is deemed to be acceptance of these Terms & Conditions.

2. Entry is open to Australian residents. Employees and their immediate families of Flair Industries and their agencies and companies associated with this promotion are not eligible to enter. If a Winner is under 18 years of age on the Draw Date the prize will be awarded to the Winner’s parent or legal guardian.

3. PROMOTIONAL PERIOD: The Competition commences at 9:00am (AEST) 14 June 2010 and closes 11:59pm (AEST) on 16 July 2010. All entries must be received by Flair Industries by 11.59pm (AEST) on 16 July 2010.

4. HOW TO PARTICIPATE: To enter, Myer customers must during the promotional period

a. purchase a Flair Suit or Suit Separate at either the Myer Melbourne City, Myer Chadstone, Myer Doncaster, Myer Eastland, Myer Southland, Myer Northland, Myer Highpoint, Myer Knox City and Myer Adelaide City store; and

b. subscribe to Flair Alliance Network (FAN) online at www.flairindustries.com.au - Registration to FAN is free; and

c. Complete the online entry form on the website under your registered login www.flairindustries.com.au

Entries must be made online via www.flairindustries.com.au and is limited to one entry per transaction per FAN Member. Where multiple entries are received the first valid entry received will be the accepted entry. All other entries will be disqualified from the promotion. The FAN account must be active and valid during the Promotional Period and at the time of the Draw in order to be eligible for the Prize.

5. PRIZE: There will be a total of one (1) winner of the competition. The Winner will receive an ultimate Collingwood Inner Sanctum Experience pass for two (2) to the Collingwood vs. Carlton AFL match at the MCG on Saturday 31 July 2010 at 2:10pm. The Prize must be redeemed on 31 July 2010 at 2:10pm (AEST) strictly. The total Prize value is AUD$700. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken. Flair Industries will arrange travel if this required for Adelaide winners. All travel arrangements will be made at the Promoters discretion.

6. DRAW: The Draw will take place at 9:00am (AEST) 21 July 2010 (AEST) at Flair Industries, Level 4, 6 Albert Street, Preston, VIC 3072.The winner will be notified in writing and published in The Age newspaper on 23 July 2010. The Promoter's decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

7. Entrants must retain their original Myer receipt, which must be presented as evidence of eligibility, if requested by the Promoter. Faxed, scanned or photocopied Myer receipts will not be accepted. There must be a qualifying sale at the time of the Draw. Where the Flair Suit or Suit Separate is returned or exchanged for a different brand during the Promotional Period and prior to the Draw, the entry will be deemed as void and is not eligible to win.

8. The Winner may be required to execute a Deed of Acknowledgement, Release and Indemnity in a form prescribed by the Promoter, at the Promoter’s discretion.

9. Subject to State government legislation, an unclaimed prize from all non-winning entries will be conducted in the same manner and on the same conditions as the Draw. The second draw will take place on at 9:00am Friday 23 July 2010 (AEST) at Flair Industries, Level 4, 6 Albert Street, Preston, VIC 3072

10. Entries will be deemed to be accepted at the time the eligible completed entry form is received in the competition database by 11:59pm (AEST) on 16 July 2010 and not the time of transmission. No responsibility will be taken for late or lost entries.

11. Internet charges may apply and is the responsibility of the entrant. No responsibility accepted for late, lost, incomplete or misdirected entries. No responsibility will also be accepted for late purchases or late registrations to the FAN program. All requirements must be met by 11:59 (AEST) Sunday 16 July 2010.

12. Unless expressly stated in these Terms and Conditions all expenses become the responsibility of the Winner. The Winner (and their companion) are responsible for all expenses including but not limited to spending money, transfers, meals, drinks, accommodation, incidentals, telephone calls, activities, insurance, taxes, energy surcharges, gratuities and services charges.

13. The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Independent financial advice should be sought prior to entering the competition or claiming the prize.

14. Customers must retain their original Myer receipt, which will need to be produced as evidence of eligibility, and must be presented at the request of the Promoter. Faxed, scanned or photocopied Myer receipts will not be accepted. Where the Flair Suit or Suit Separate is returned or exchanged for a different brand during the promotional period and prior to the Draw, the entry will be deemed as void and is not eligible to win.

15. The Winner accepts the Prize at their own risk. The Prize must be taken as stated and no compensation will be payable if the Winner is unable to use the Prize as stated. The Prize is not transferable and cannot be redeemed for cash or other goods or services or sold to a third party including online auctions and private sales. Unused portions of the Prize will be forfeited and no compensation will be paid in lieu of that element of the Prize.

16. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion and for the facilitation of the FAN program. To facilitate the promotion, your participation, the Promoter may disclose your personal information to other companies associated with this promotion. Entry into the promotion is conditional on each entrant providing the necessary information and joining the FAN program. Use of such information will be in accordance with the FAN program Terms and Conditions. For details on the FAN program privacy policy, please see www.flairindustries.com. Entrants’ personal information may be disclosed to State and Territory lottery department s and the winner’s name published as required under the relevant lottery legislation.

17. By entering this promotion each entrant agrees to participate and co-operate with the Promoter as required in all editorial and promotional activities relating to the Competition, including but not limited to being interviewed and photographed for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter for an unlimited period of time without remuneration. The Winner also agrees to grant to the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

18. The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, without prior notice.

19. The Promoter is not responsible for any incorrect or incomplete information communicated to any party including through advertisements in the course of or in connection with this Promotion.

20. In the event that the prize (or any part thereof) is not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute all or part of the prize of equal value, subject to any written directions from a relevant Regulatory Authority

21. The Promoter’s responsibility for the provision of any prize is limited to the Prize described in these Terms and Conditions. To the maximum extent permitted by law the Promoter accepts no liability for any failure of the Promoter’s suppliers, agents or contractors to supply the Prize as stated or for any loss or liability that may be suffered or incurred (including but not limited to indirect or consequential loss) by any party howsoever as a result of a Winner (or their parent or guardian) accepting a prize. Each entrant agrees to accept responsibility for any loss or liability that may be suffered or incurred (including but not limited to indirect or consequential loss) of any party howsoever caused whether as a direct or indirect consequence of entering the Promotion or accepting a Prize.

22. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.

23. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

24. The Promoter reserves the right to verify the validity of entries, at any time during or after the promotion, and reserves the right to disqualify any entrant (and all entries submitted by that entrant) for failing to comply with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

25. The Promoter reserves the right to request winners to provide proof of identity and residency at their nominated address. Identification considered suitable for verification is at the discretion of the Promoter.

Terms & Conditions – Presidents Lunch, 31st July 2010

1. Information on how to enter and receipt of the prize forms part of these conditions of entry. Entry into this competition is deemed to be acceptance of these Terms & Conditions.

2. Entry is open to all Australian residents. Employees and their immediate families of Flair are not eligible to enter. If a winner is under 18 years of age on the Draw Date the prize will be awarded to the winner’s parent or legal guardian.

3. PROMOTIONAL PERIOD: 9.00am (AEST) 14 June 2010 to 11.59pm (AEST) 16 July 2010

4. HOW TO PARTICIPATE: To enter, participants must be subscribed to FAN (Flair Alliance Network) and must tell the Promoter in 25 words or less why they should be selected as the winner. Entries must be e-mailed to competition@flairindustries.com by competition close 11.59pm (AEST) 16 July 2010. Participants are required to be an active member of FAN up until and including the promotional period

5. PRIZE: A place for you and a friend of your choice at the Collingwood Presidents lunch to be held on 31 July 2010, starting 12.00pm (AEST). The lunch includes viewing of the Collinwood vs Carlton Football game, starting at 2.10pm (AEST), from reserved seating at the MCG. For out of state winners travel will be arranged. All travel arrangements will be made at the Promoters discretion.

6. DRAW: Three (3) entries will be chosen as winners at the Promoters discretion. The winning entries will be announced on 19 July 2010. The winner will be notified by e-mail and/or phone and the winners names published on the Flair Industries website, www.flairindustries.com.

7. The promoter's decision is final and the promoter will not enter into correspondence regarding the result.

9.It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

10. Subject to State government legislation, an unclaimed prize will be forfeited.
